This Privacy Policy describes the types of information GODDESS VIBES® (“we,” “our”, or “us”) collect from the website visitors (“visitors” or “you”) on the Sites, how we use such information and to whom and under what circumstances we may disclose it. This Privacy Policy applies only to this website (http://www.goddessvibesinc.com), our mobile sites, and our use of social media sites (collectively, the “Sites”), and any other personal information obtained when you call, email, or otherwise communicate with Goddess Vibes®.  By accessing the Sites on any computer, mobile phone, tablet, or other device, making a purchase from Goddess Vibes®, or otherwise interacting with Goddess Vibes®, you agree to the terms of this Privacy Policy.  If you do not agree to the policy, please do not use the Sites.

We may modify this Privacy Policy at any time, and will post the current version on the Sites.  We encourage you to periodically review our Privacy Policy to stay informed about how we are using the information we collect.

1. PERSONAL INFORMATION THAT YOU GIVE US

We collect personal information from you when you submit it to us through the Sites, including by: (1) making a purchase; (2) creating an account; (3) participating in our rewards program; (4) signing up for our newsletter; or (5) contacting us.  This information may include, for example, your name, email address, mailing address, billing address, telephone number, and payment method.  We may combine the information we collect from you with information we receive about you from other sources, such as address update services.

We do not process credit card information.  We work with vendors who process your credit card information when you make a purchase on the Sites.  We only store a record that the transaction took place.

We may collect personal information from you when you write a review on our Sites. However, we do not ask, and you should not enter, your full name anywhere in your review.

1. PERSONAL INFORMATION THAT WE COLLECT AUTOMATICALLY

When you visit the Sites, we may automatically collect certain information from you, including your Internet Protocol (IP) address, MAC address, browser type, operating system, device-identifying information, the specific web pages visited during your connection, and the domain name from which you accessed the Sites. In addition, we may collect information about your browsing behavior, such as the date and time you visit the Sites, the areas or pages of the Sites that you visit, the amount of time you spend viewing the Sites, the number of times you return to the Sites and other clickstream data.

Like many commercial websites, we place Internet cookies on your hard drives through our Sites. Internet cookies save the visitor’s name, password, user-name, screen preferences, the pages of the Sites viewed by the visitors, and the advertisements viewed or clicked by the visitors.  One reason for use of cookies is that the user will not be prompted to enter a username and password each time he wishes to view a protected area of the Sites. When a visitor performs a search on the search engine available on the Sites, the Sites record information identifying the visitor or linking the visitor to the search performed. As necessary to provide service, we record limited information for every search request and use that information only to solve technical problems with the service and to calculate overall usage statistics.

1. USE OF PERSONAL INFORMATION COLLECTED

We may use the personal information we collect from and about you for any of the following purposes: (1) editorial and feedback purposes, (2) marketing and promotional purposes, (3) statistical analysis of visitors’ behavior, (4) product development, (5) content improvement, (6) informing advertisers as to how many visitors have seen or clicked on their advertisements, and (7) content customization.  The personal information on visitors’ home servers is aggregated for internal review and then discarded.  The names, postal and e-mail addresses, and phone numbers collected may be added to our databases and used for future calls and mailings regarding any updates of our Sites, our new products and services, our upcoming events, and the status of orders placed online.

If you are resident in the United Kingdom or European Economic Area (together “Europe”) at the time when we provide services to you, the data processing information in Section 9 below applies to the use of your personal information. If you are resident in California, the data processing information in Section 10 below applies to the use of your personal information.

1. DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES

We may disclose information collected from and about you as follows: (1) to our related companies and service providers, to perform a business, professional or technical support function for us; (2) to our marketing partners, advertisers or other third parties, who may contact you with their own offers; (3) as necessary if we believe that there has been a violation of the Sites’ Terms and Conditions or of our rights or the rights of any third party; (4) to respond to legal process (such as a search warrant, subpoena or court order) and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and (5) in the event that our company or substantially all of its assets are acquired, your personal information may be one of the transferred assets. We may also disclose your personal information with your express consent. We may share aggregate, non-personally identifiable information about visitors of the Sites with third parties.

Please note that if you voluntarily submit any personal information for posting on the Sites, such as a review or a blog post, the information becomes publicly available and can be collected and used by others, so you should use care before posting information about yourself online.

1. COLLECTION OF PERSONAL INFORMATION FROM CHILDREN

The Sites are not directed to children under the age of 18, nor do we knowingly collect any personal information from children under the age of 13 without verifiable parental consent.  If you believe that a child has provided personal information to us, please contact us promptly as detailed in the “Contact Us” section below, and we will endeavor to investigate and delete such information from our systems.

1. THIRD PARTY WEBSITES

The Sites may contain links to third-party websites, such as social media sites like Facebook, Instagram, and YouTube, which may have privacy policies that differ from ours. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policy posted on any external site before disclosing any personal information. Please contact those websites directly if you have any questions about their privacy policies.

We reserve the right to contact you regarding your purchase, membership status, changes to the subscriber agreement, privacy policy, or any other policies or agreements relevant to the visitors of our Sites.

We may change this Privacy Policy from time to time, including as required to keep current with rules and regulations, new technologies and security standards. When we do, we will post the change(s) on our Sites and display an effective date on the policy in the upper left corner of this Privacy Policy so that it will be easier for you to know when there has been a change.  If we change the Privacy Policy in a material and retroactive manner, we will provide appropriate notice to you.

1. EUROPEAN RESIDENTS PRIVACY INFORMATION

If you are a European resident individual, you have certain rights in relation to your personal information under the applicable European data privacy laws. This section only applies to such visitors. Under applicable European data privacy laws, we are the data controller.

(a) Your Rights to Control Your Personal Information

Applicable European data privacy laws gives certain visitors the right to access their personal information. Your right of access can be exercised in accordance with the European data privacy laws. If you would like to request a copy of your personal information being held by us, or request that it is deleted or to update and/or correct your personal information or request that we provide a copy to another data controller of your personal information that you have provided to us, please contact us as detailed in the “Contact Us” section below. We will need enough information to ascertain your identity as well as the nature of your request. We will aim to respond to your request within one (1) calendar month of receipt of the request. Where we were unable to do so within the calendar month, we will notify you of the soonest practicable time within which we can respond to your request (and within three (3) months from the date of your request).

There are certain exemptions and restrictions of these rights under the European data privacy laws that enable personal information to be retained, processed or withheld from access and we will inform you of these, if applicable. (b) We use your Personal Information for the following key purposes:

• to contact you: subject to applicable law, we or our third-party service and business providers may send you communications; especially if you have subscribed to one of our services. We share your personal information with third parties to help us use your personal information, as described in the Privacy Policy and in addition, we may need to share your personal information with our professional tax, legal, audit or financial advisors as well as sponsors, members, and other organizations in the proper course of our business. We may also share your personal information when we receive requests for information in the context of legal disputes, investigations regulatory enquiries or similar requests.

We use cookies to manage the operation of our Sites as detailed in Section 2 above.  Our Sites use the following types of cookies:

1. CALIFORNIAN RESIDENTS PRIVACY INFORMATION

California law permits our visitors who are California residents to request certain information about our disclosure of personal information to third parties for their own direct marketing purposes during the preceding calendar year. This request is free and may be made once a year. To make such a request, please contact us as detailed in the “Contact Us” section below.  Please allow up to 30 days for us to process your request.  You may submit such a request once per year.

If you are a California resident, California law also provides you with the following rights with respect to your personal information:

• The right to know what personal information we have collected, used, disclosed and sold about you. To submit a request to know, please contact us as detailed in the “Contact Us” section below.  You also may designate an authorized agent to make a request for access on your behalf.
• The right to request that we delete any personal information we have collected about you. To submit a request for deletion, please contact us as detailed in the “Contact Us” section below. You also may designate an authorized agent to make a request for deletion on your behalf.
• You have the right to opt-out of the sale of your personal information by contacting as detailed in the “Contact Us” section below. You also may designate an authorized agent to make a request to opt-out of the sale of your personal on your behalf.

When you exercise these rights and submit a request to us, we will verify your identity by asking you to log in to your account if you have one with us.  If you do not have an account with us, we may ask for your email address, telephone number, or other information.  We also may use a third party verification provider to verify your identity.  We will endeavor to honor your requests unless such a request conflicts with certain lawful exemptions under the California Consumer Privacy Act of 2018.  Please note that we are only required to honor such requests twice in a 12-month period.
